This service includes reconciliation as a professional activity in a broader sense and family reconciliation in a narrower sense, regardless of whether those being reconciled decide to approach the mediator independently or are referred to family reconciliation.
- Conciliation service
The conciliation service is not directly a legal service, but it also includes these elements. Conciliation service is one of the methods of restorative law, the aim of which is to ensure the rectification of the act, the satisfaction of the victim and the community, and the cessation/reduction of wrongdoing and crimes in the future. with the aim of helping them find a solution to the dispute. Based on the circumstances of the conciliation and the progress of the conciliation procedure, the conciliator may submit his own solution proposal to the parties. - Family Mediation service
The family mediation service is also not directly a legal service. Family mediation is carried out to a certain extent on the basis of the Conciliation Act (LepS), but to a certain extent based on the practice and tradition of international mediation (Family Mediation), which is not directly regulated by law in Estonia. The family mediation service is a family mediation procedure conducted by a mediator for a fee, where the parties to the mediation can agree on the procedure for communication with the child stipulated in the Family Act or issues related to the maintenance of a minor child through the mediation of a conciliator. - State-Funded Family Mediation Services
From 01.09.2022, the State-Funded Family Mediation Services will be implemented, during which a conciliation procedure will be ocumen out on the basis of the State-Funded Family Mediation Services Act (RPLS) and through the intermediary of a family mediator, as a result of which the parties to the mediation can agree on issues related to the right to communicate with the child or the maintenance of a minor child provided for in the Family Act.From 01.07.2023, agreements related to custody will be added to the the State-Funded Family Mediation Service, if the court has issued an order for referral to family mediation and the parents want to agree that joint custody will be partially or fully terminated and custody will be partially or fully transferred to one parent.
Such an agreement is confirmed as an executive document. The provision of State-Funded Family Mediation Service is ensured by the Social Insurance Board as a conciliation body.
